Probate & Intestate Estates

Guardianships & Conservatorships

If an adult person is determined to lack sufficient capacity to make or communicate significant responsible decisions concerning their health or safety or the management of their property, a judge may find that the appointment of a Guardian or a Conservator is in that person's best interest. A Guardian or Conservator is most often appointed due to the progression of dementia, or any disability which affects mental capacity. Whereas a Guardian is granted authority over one's person and healthcare, a Conservator has authority over one's property and finances. Guardianships and Conservatorships should only be imposed when no reasonable alternatives are available, as basic rights are removed from the individual, referred to as the "Ward." Regardless of your role in the proceedings, the process can be emotional and overwhelming, but our team will be by your side to protect your interests and those of your loved ones.
